COBA: U.S Department of Labor "Back Wages Due" letter

Dear COBA Members,

Over the last week, COBA was contacted by active members and retirees who received letters in the mail appearing to be from the U.S. Department of Labor in regards to “Back Wages Due.”

After sending these forms to both the Unions “in-house” counsel and the NYC based law firm dealing with the FSLA lawsuit, they have both come to the same conclusion.

It appears the dates listed may be different from those included in the lawsuit, however, by signing anything as a settlement, it clearly states at the bottom of the letter you will be signing your rights away. It doesn’t clearly state where that time frame begins and ends. So for all of the COBA members currently involved in the ongoing FLSA lawsuit, it was recommended that you DO NOT sign anything and do NOT take any settlement that was negotiated between the County and Department of Labor.
